Terms of Service

These Terms are the agreement between you and Jakub Gierasimiuk about your use of Riposte. Please read them — they cover what you can expect from us, what we expect from you, and what happens if something goes wrong. By installing or using the app, you accept them.

1.Who we are

Riposte (the “App”) is provided by Jakub Gierasimiuk, a sole proprietor (jednoosobowa działalność gospodarcza) registered in Poland (“we”, “us”). Contact details are in section 14.

2.What Riposte is — and isn’t

Riposte is a training tool for witty comebacks and verbal self-defence. It lets you practice responses to attacks and sharp remarks with AI-assisted scoring and example lines. It is a lightweight game-like experience, not:

• psychological, medical, legal, or financial advice,
• a crisis-support or mental-health service,
• a tool for harassing, bullying, or harming other people.

If you are in distress or facing ongoing abuse, please reach out to a qualified professional or local support services.

3.Eligibility

You must be at least 13 years old to use Riposte (16 in the European Economic Area, or the minimum age set by local law, whichever is higher). If you are under 18, you must have permission from a parent or legal guardian.

4.Your account

• Provide accurate information when creating your account.
• Keep your login credentials secure — you are responsible for activity on your account.
• Tell us at support@getriposte.app if you suspect unauthorised access.
• You may delete your account at any time from Profile → Delete Account.

5.Licence to use the App

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use Riposte on devices you own or control, for non-commercial purposes.

You may not:

• copy, modify, decompile, reverse-engineer or otherwise extract the source of the App, except to the extent the law allows you to without our consent;
• rent, lease, resell, sublicence or commercially exploit the App or its content;
• scrape, bulk-download or otherwise harvest content from the App;
• circumvent any technical protection, rate limit, paywall or subscription gate;
• use the App to generate or distribute content that is unlawful, hateful, threatening, defamatory, sexually explicit, or directed at harassing identifiable individuals.

6.Subscriptions & payments

Some features of Riposte are free; others require a paid subscription (“Pro”). Pricing and available plans are shown in the App before you buy.

• Purchases are processed by Apple (App Store) or Google (Play Store). Their terms apply to billing, refunds and taxes. We never see your payment-card details.
• Subscriptions auto-renew for the same billing period unless cancelled at least 24 hours before the end of the current period. Cancellations are made through your App Store / Play Store account.
• We may change prices with at least 30 days’ notice. If you don’t accept a price change, cancel before it takes effect.
• Consumer rights under EU / Polish law to withdraw from digital-content purchases within 14 days are respected, subject to the specific exceptions set out in Art. 38 of the Polish Consumer Rights Act (e.g. where you expressly consent to immediate supply).

7.Your content

When you type or speak into the App (“Your Content”) you keep ownership of it. You give us a worldwide, royalty-free, non-exclusive licence to process Your Content for the sole purpose of running the App — that means: sending it to our AI providers for scoring, storing it in your session history, showing it back to you, and producing anonymised and aggregated statistics to improve the product.

You are responsible for what you submit. Don’t paste other people’s private communications, confidential information, or anything you don’t have the right to share.

8.AI output

Riposte uses large language models to score your ripostes and generate example counter-lines. AI can be clever, dull, cliché, or occasionally wrong. Treat its output as training material, not a final verdict on anything.

You are solely responsible for what you do with suggestions the App gives you in real-world conversations. Don’t use AI-generated lines to bully, threaten, defame, or discriminate against anyone.

9.Intellectual property

The App, its design, branding, scenario library, techniques catalogue, and all Riposte content are owned by Jakub Gierasimiuk or our licensors and are protected by copyright and other laws. These Terms do not transfer any of those rights to you.

“Riposte” and the Riposte logo are trademarks of Jakub Gierasimiuk. Use of them requires our prior written permission.

10.Service availability

We work hard to keep Riposte running, but we don’t promise the App will always be available, error-free, or compatible with every device. We may add, change or remove features, and we may temporarily suspend the service for maintenance. Where a change materially reduces what you are paying for, we will give reasonable notice and, where required, offer a refund or alternative.

11.Warranties & liability

Nothing in these Terms limits any rights you have as a consumer under applicable law that cannot legally be limited. Subject to that:

• The App is provided “as is” and “as available”. To the maximum extent permitted by law we disclaim all implied warranties except those we are obliged to provide as a consumer-facing service.
• We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of your use of the App.
• Our total liability to you in any 12-month period for any claim connected with the App is limited to the greater of (a) the amount you paid us for the App during that period, or (b) €50.

12.Termination

• You can stop using the App and delete your account at any time.
• We may suspend or terminate your access if you materially breach these Terms, abuse the service, or attempt to harm other users. Where practical, we will give you notice and a chance to fix the issue.
• Sections that by their nature should survive termination (Sections 7, 9, 11, 13, 14) will continue to apply after your account ends.

13.Governing law & disputes

These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

Disputes arising out of or in connection with these Terms are subject to the jurisdiction of the common courts in Poland competent for our registered office, except that consumers may bring claims in the courts of their country of residence, as their mandatory local law requires.

Online dispute resolution: the European Commission provides an online dispute-resolution platform at ec.europa.eu/consumers/odr.

14.Changes & contact

We may update these Terms. If the changes are material, we will notify you through the App and / or by email at least 14 days before they take effect. Continuing to use the App after that means you accept the new Terms.
